Website Usage Guidelines

Comprehensive rules and guidelines that dictate the terms for using our website and services.

TERMS OF USE

[Updated 07/21/2024]

The information provided on this website is for informational purposes and is not to be considered a substitute for professional medical advice, diagnosis, or treatment. If you have questions or concerns about your general health, please talk to your doctor. If you feel you are experiencing a medical emergency, call 911 immediately.

These Terms of Use govern your access to and use of our website, maxtrt.com (the “WEBSITE”), which is owned and operated by Sozo Group, LLC and marketed under the brand of their subsidiary, Andrologix Health and Wellness, LLC (collectively referred to as “we,” “us,” “our,” or “the COMPANY”), including their affiliates. By accessing or using this WEBSITE, you agree to comply with and be bound by these Terms of Use. If you do not agree with these Terms, please do not use the WEBSITE.

1. Acceptance of Terms

By accessing or using the WEBSITE, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the WEBSITE.

2. Services Provided & Availability of Services

The WEBSITE is designed to provide information about our services and to facilitate the acquisition of leads for individuals interested in scheduling an appointment with a doctor for telemedicine consultations, in-person evaluations, and treatment solutions. Please note that we do not provide medical services, nor do we sell products directly through the WEBSITE. The WEBSITE serves as a destination for online advertising and information dissemination.

Our healthcare professionals can prescribe medications or therapy services only to those patients who have a clinical need. To determine clinical necessity, patients must complete any required forms, lab work, physician consultations, examinations, and medical history reviews. Completing these steps does not guarantee treatment; eligibility is determined solely by the prescribing physician.

The COMPANY and our affiliates operate subject to state and federal regulations. As a result, all services might not be available in your particular area.

Testosterone Replacement Therapy: Prescription hormones, classified as Schedule III substances, require an online consultation with one of our licensed healthcare providers. They will discuss the benefits and potential side effects of hormone therapy with you before deciding if you are a suitable candidate. Depending on DEA regulations and state laws, treatment involving testosterone may necessitate an in-person medical examination by the prescribing physician. Further details will be provided by your client liaison during your initial consultation.

Use of the WEBSITE is limited exclusively to users located in States within the United States where the services offered are available. Services are not available to users located outside the United States. Accessing the WEBSITE from jurisdictions where content is illegal, or where we cannot offer services, is prohibited.

3. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any changes to these Terms of Use constitutes acceptance of those changes. If you do not agree to the new terms, you must stop using the services.

4. Use of the WEBSITE

You may use the WEBSITE solely for lawful purposes and in accordance with these Terms of Use. You agree not to use the WEBSITE:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To engage in any fraudulent, deceptive, or misleading activities.
  • To impersonate or attempt to impersonate the COMPANY, our employees, other users, or any other person or entity.
  • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the WEBSITE, or which, as determined by us, may harm the COMPANY or users of the WEBSITE.

5. Risks associated with Telemedicine

By using the WEBSITE to request services, you acknowledge and understand the potential risks associated with telehealth services. These risks include, but are not limited to, the following:

  • Limited Information Transmission: Information transmitted during telehealth consultations, such as poor resolution of images or audio, may hinder the Provider’s ability to make accurate medical or health care decisions.
  • Equipment Failures: Delays in evaluation or treatment could occur due to failures in electronic equipment, including but not limited to internet connectivity issues, hardware malfunctions, or power outages.
  • Incomplete Medical Records: The absence or limited access to your complete medical history may result in adverse drug interactions, allergic reactions, or other judgment errors during the telehealth consultation.
  • Security Risks: While our electronic systems employ network and software security protocols to safeguard the privacy and security of health information, there is a potential risk that these protocols could fail, leading to unauthorized access or a breach of your health information privacy.
  • Technological Limitations: Telehealth services rely on technology that may have limitations, such as interruptions or failures in the video or audio connection, which could impact the quality and effectiveness of the consultation.
  • Lack of Physical Examination: Telehealth consultations may not include a physical examination, which is typically part of traditional in-person medical visits, potentially limiting the Provider’s ability to fully assess your health condition.
  • Emergency Situations: In cases of medical emergencies or urgent conditions, telehealth services may not be suitable or may not provide timely access to appropriate medical care compared to in-person consultations.
  • Legal and Regulatory Risks: The practice of telemedicine is subject to legal and regulatory requirements that may vary between jurisdictions, affecting the scope and delivery of healthcare services through telehealth platforms.

These risks are inherent to the use of telehealth services and may vary depending on individual circumstances and technological factors. It is important to carefully consider these factors when deciding whether telemedicine is an appropriate option for your healthcare needs.
